TERMS OF USE

1. Objective and guarantee

These terms of sales regulate the agreement between FUSCO & Co. S.L company (hereafter FUSCO Y CO.), whose address is C/ Pintor Maella, 21B 46023 Valencia (Spain), duly registered with the Mercantile Register of Valencia Tome 3420, Book 733, Sheet 1, Page V-10204 and with VAT NUMBER ESB-96011853, and the customer (hereafter the Customer) formalized through the shop online shop.sidecarweb.com (hereafter the Shop) for the purchase by the Customer of fashion products and accessories through the Shop.

The items offered on the Shop are a selection of the Sidecar Collection and meet the same quality requirements and guarantee as the products placed in the market by the sales points of our brand. You can consult the catalogue of our whole collection through our website www.sidecarweb.com and use the contact form to check the availability of items not available in the Shop.

Fusco & Co. was worried about reflecting the colours of the garment the most closed to the reality. Nevertheless, the colour if the items in the screen can be altered with respect to the reality, depending of several factors beyond our control. Fusco & Co. cannot guarantee that the colours reflected in your screen are fitting the reality.

The special offers and promotions or discounts shall apply until the date indicated or until end of stock.

Fusco & Co. can change these Terms of Sale at any time, without notice to the Customer.

2. Purchasing process

2.1. Eligibility for purchasing

To be allowed to make an order through the Shop, the Customer must have over 18 years of age and must be the final customer. The legal minors are expressly excluded.

2.2. How to make the order?

To make the order through the Shop you shall follow these steps:
- Chose the item you want and add it to the Shopping Cart.
- Click on the link “Check out” in order to process the formality of the order.
- Check in the “Shopping Cart Summary” that the items showed are the items you want, as well as the quantity and price of them and, if you are satisfied with, click on “Next”.
- Register as client or identify if it’s not the first time you buy in the Shop.
- Select the delivery address and introduce any comment you consider appropriate for the order.
- Confirm the delivery service and the agreement of these Terms of Sale and click on “Next”.
- Click on the payment method you want to use to make the payment.
- If the payment is successful operated, the Customer will receive a confirmation of receipt of order. With the exception of the circumstances described in 2.3 and 2.4 below, this confirmation will constitute the agreement from Fusco & Co. for the Customer’s order and suppose a binding contract between the Customer and Fusco & Co.
It’s recommended that the Customer print and/or save a copy of the Terms of Sale when making the purchase.  
A confirmation of the reception of the order will be issued to the Customer's email. It’s recommended that the Customer print or download a copy for possible enquiries.

2.3. Product Availability
The culmination of the order through the website is subject to the availability of the items. Fusco & Co. seek to ensure the stock of all the items in sale.
If, for any reason, the product ordered is not available, the Customer will be informed by email and will be refunded the total amount paid not later than 30 days after the payment.

2.4 Fusco & Co.’s right to cancel or not to accept an order
Fusco & Co. retains the right to decline any order, cancel it or not to accept an order confirmed for the following reasons:
- A technical failure or pricing error in the Website when the order was made.
- The product of the order is not available.
- The payment information provided is incorrect or unverifiable.
- The security systems indicate that the order is anomalous or can be fraudulent.
- Fusco & Co. couldn’t, after 3 attempts, deliver the goods in the address provided.     

3. Price and Payment

3.1 Price and currency
The price and the offers presented in the website are in EUROS, including VAT (Value Added Tax) and only are valid for the orders made online through the Website.

3.2. Form of payment
For the order the Customer can use the following credit or debit card: Visa, Visa Electron, MasterCard or PayPal. The charge will be issued after the confirmation of the order.

3.3. Price changes
The prices in the Website are subject to change. Fusco & Co. retains the right to change the prices without notice. Nevertheless, after the reception of the confirmation of the order, the prices will not be change.

4. Returns

4.1. Return for faulty items or wrong deliveries
The client is granted the right to return purchased of faulty items or for difference of the products ordered.
The Customer has a period of 48 hours from the delivery to communicate it to Fusco & Co. S.L. and to proceed to send it back until 10 days after the communication of the courier company by Fusco & Co. S.L. If any of the two conditions is not fulfilled, Fusco & Co. will assume that it’s accepted. Fusco & Co. will refund the value of the product closed the corresponding sending costs.

4.2. Return of the products for any reason (Right of Revocation)
If the client is not satisfied with the products purchased, the Customer has a period of 10 calendar days from the delivery to send back the product with no need to give no explanation. The Customer can return the products ordered whenever:
- The product was neither wash nor used (except the reasonable wearing out as result of the verification and try on the product).  
- The product is complete (two pieces that form a couple have to be return joined).
- The item must be returned in its original packaging and with its originals labels.
- The involved sending cost will be borne by the buyer.
If a return doesn’t comply with the requirement, the amount will not be refund and the item will be sent back to the Customer with the cost pay by him.

4.3. Replacement of products
At present, the products can’t be changed. To obtain a product in other colour or in other size, the Customer has to return the original item, paying the corresponding sending costs for the return and make a new order through the Shop.

4.4. Refund
The refund will be issued in the original payment form and currency.
Fusco & Co. will not make any refund before receiving the product of the return and before checking its condition in the warehouse; once checked the condition of the product, the Customer will receive the refund with the corresponding amount at later thirty (30) days after the reception of the product.

5. The validity of the offers
The promotional offers showed in the Website to increase the sales of some products it’s only validating during its apparition in the Website, unless the otherwise indication on it.

6. Applied Legislation and competent jurisdiction
The purchases made through the Website of Fusco & Co. and underneath these Terms of Sale are subject to the Spanish legislation.
Any disputes or disagreement arising out of the application or interpretation of the Terms of Sale, as well as the contracts that provide, will be resolved before the tribunals of the city of Valencia, Spain, that will have exclusive competence rising above all other jurisdictions.
